Important information about attending Sound Haven Festival
Welcome to Sound Haven Music Festival ("Sound Haven," "Festival," "Event"), operated by Sound Haven Fest LLC ("we," "us," or "our"). By purchasing a ticket, entering the Festival grounds, or participating in any Festival activities, you ("Attendee," "you," or "your") agree to be bound by these Terms and Conditions. Please read these terms carefully before purchasing tickets or attending the Festival.
IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS, DO NOT PURCHASE A TICKET OR ATTEND THE FESTIVAL.
1. Ticket Purchase & Entry
1.1 Ticket Validity
- All tickets are non-refundable and non-transferable unless otherwise stated
- Tickets are valid only for the date(s) specified on the ticket
- Entry is subject to availability and venue capacity limits
- We reserve the right to refuse entry or remove any person from the Festival at our sole discretion
- Lost, stolen, or damaged tickets cannot be replaced
1.2 Age Requirements
- The Festival is open to all ages, but minors under 18 must be accompanied by a parent or legal guardian at all times
- Valid government-issued photo ID is required for entry and for alcohol purchases
- Anyone under 21 attempting to purchase or consume alcohol will be removed from the Festival without refund
- Wristbands will be issued at entry for age verification purposes
1.3 Entry & Security
- All persons and belongings are subject to search upon entry and at any time during the Festival
- We reserve the right to use metal detectors, bag searches, and other security measures
- Refusal to submit to search will result in denial of entry without refund
- Re-entry policies may apply; check Festival information for details
2. Prohibited Items & Conduct
2.1 Prohibited Items
The following items are strictly prohibited and will result in confiscation and possible removal from the Festival:
- Weapons of any kind (firearms, knives, tasers, pepper spray, etc.)
- Illegal drugs or substances
- Outside food or beverages (including alcohol)
- Glass containers of any kind
- Professional cameras or recording equipment (without prior authorization)
- Drones or remote-controlled aircraft
- Laser pointers
- Large bags or backpacks (size restrictions apply)
- Chairs or blankets larger than specified dimensions
- Fireworks, flares, or explosives
- Animals (except certified service animals)
- Unauthorized vendor merchandise
- Chains, studded jewelry, or spiked accessories
- Any item deemed dangerous or inappropriate by security staff
2.2 Prohibited Conduct
- Fighting, aggressive behavior, or harassment of any kind
- Illegal drug use or possession
- Excessive intoxication or disorderly conduct
- Moshing, crowd surfing, or other dangerous activities
- Unauthorized vending or solicitation
- Sitting on shoulders or blocking views of other attendees
- Climbing on structures, fences, or equipment
- Damaging property or facilities
- Violating local, state, or federal laws
3. Health & Safety
3.1 Assumption of Risk
By attending the Festival, you acknowledge and assume all risks associated with attendance, including but not limited to:
- Risk of injury from crowd activities, weather conditions, or venue hazards
- Exposure to loud music and sound levels that may cause hearing damage
- Exposure to strobe lights, lasers, and visual effects
- Risk of illness or communicable diseases
- Risk of loss or theft of personal property
- Physical and mental health risks associated with large gatherings
3.2 Medical Attention
- Medical staff will be available on-site for emergencies
- You are responsible for any medical expenses incurred during the Festival
- We recommend attendees bring necessary medications and medical supplies
- Notify staff immediately if you witness a medical emergency
3.3 Weather & Environmental Conditions
- The Festival is primarily an outdoor event and will proceed rain or shine
- Severe weather may cause delays, evacuations, or cancellation
- We are not responsible for weather-related inconveniences
- Attendees should prepare for varying weather conditions
4. Cancellation, Postponement & Refunds
4.1 Event Changes
- We reserve the right to modify the Festival schedule, lineup, or venue at any time
- Lineup changes, including artist cancellations or substitutions, do not constitute grounds for refunds
- The Festival may be postponed or rescheduled due to circumstances beyond our control
- We will make reasonable efforts to notify attendees of significant changes via email and social media
4.2 Refund Policy
- All ticket sales are final - no refunds or exchanges
- Refunds will only be issued if the Festival is completely cancelled and not rescheduled
- Weather delays, lineup changes, or shortened performances do not qualify for refunds
- If the Festival is cancelled, refunds will be limited to the ticket face value (not including fees)
- Refund processing may take 30-60 days from the cancellation date
- We are not responsible for travel, accommodation, or other expenses related to Festival attendance
4.3 Force Majeure
We shall not be liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemics, government restrictions, strikes, terrorism, war, or venue unavailability.
5. Recording & Media
5.1 Photography & Video
- Personal, non-professional cameras and smartphones are permitted for personal use only
- Professional cameras, video equipment, and GoPros are prohibited without prior authorization
- Commercial use of any photos or videos taken at the Festival is strictly prohibited
- Live streaming or recording of performances without permission is prohibited
5.2 Use of Your Image
By attending the Festival, you grant Sound Haven Fest LLC and its affiliates the irrevocable right to use your image, likeness, voice, and appearance in any photographs, videos, or recordings taken at the Festival for promotional, marketing, or commercial purposes without compensation or approval. This includes use on social media, websites, advertising, and other media.
6. Intellectual Property
All Festival content, including but not limited to logos, branding, music performances, stage designs, and promotional materials, are protected by copyright, trademark, and other intellectual property laws. Unauthorized use, reproduction, or distribution of any Festival content is strictly prohibited and may result in legal action.
7. Liability & Indemnification
7.1 Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SOUND HAVEN FEST LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SPONSORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM:
- Your attendance at or inability to attend the Festival
- Personal injury, death, or property damage
- Lost, stolen, or damaged personal property
- Actions or omissions of other attendees, artists, vendors, or third parties
- Festival cancellation, postponement, or changes
- Any errors or omissions in Festival information or materials
7.2 Indemnification
You agree to indemnify, defend, and hold harmless Sound Haven Fest LLC, its officers, directors, employees, agents, sponsors, and affiliates from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from your attendance at the Festival, violation of these Terms and Conditions, or violation of any laws or rights of third parties.
8. Code of Conduct
Sound Haven Festival is committed to providing a safe, inclusive, and respectful environment for all attendees. We have zero tolerance for:
- Harassment, discrimination, or hate speech of any kind
- Sexual harassment or unwanted physical contact
- Violence, threats, or aggressive behavior
- Theft, vandalism, or destruction of property
- Any behavior that endangers the safety or enjoyment of others
Violation of this Code of Conduct will result in immediate removal from the Festival without refund and may result in being banned from future events. We encourage all attendees to look out for one another and report any concerns to Festival staff.
9. Accessibility
We strive to make Sound Haven Festival accessible to all attendees. Accessibility accommodations are available for attendees with disabilities. Please contact us in advance at info@soundhavenfestival.com to arrange accommodations or request information about accessible facilities and services.
10. Lost & Found
A Lost & Found will be available at the Festival information booth. We are not responsible for lost, stolen, or damaged items. Found items will be held for a limited time and may be discarded or donated after the Festival concludes. Contact us after the Festival to inquire about lost items.
11. Privacy & Data Collection
Your privacy is important to us. Information collected during ticket purchase and Festival attendance is subject to our Privacy Policy. By purchasing a ticket or attending the Festival, you consent to the collection and use of your information as described in our Privacy Policy.
12. Disputes & Governing Law
12.1 Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State where the Festival takes place, without regard to its conflict of law provisions.
12.2 Dispute Resolution
Any disputes arising from these Terms and Conditions or your attendance at the Festival shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive your right to participate in class action lawsuits or class-wide arbitration.
12.3 Venue & Jurisdiction
You agree that any legal action or proceeding related to the Festival shall be brought exclusively in the state or federal courts located in the county where the Festival takes place, and you consent to the jurisdiction of such courts.
13. Severability
If any provision of these Terms and Conditions is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
14. Changes to Terms & Conditions
We reserve the right to modify these Terms and Conditions at any time. Changes will be posted on our website with an updated "Last Updated" date. Your continued attendance at the Festival or use of our services after changes are posted constitutes acceptance of the modified terms. We encourage you to review these Terms and Conditions periodically.
